The rules for using Ethereal, Inc. products and services

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and Ethereal, Inc. ("Ethereal", "we", "us", or "our") and govern your use of our websites and services, including:

  • Ethereal Office — an AI-powered front-office service (call answering, text messaging, and scheduling) provided to home-service businesses
  • Ethereal Planes and Ethereal Host — our spatial remote desktop applications for Meta Quest, Windows, and macOS
  • ResuBuild — our AI resume platform at resubuild.co
  • ethereal.glass — this website

By accessing or using any of our services, or by opting in to receive text messages from a phone line operated by Ethereal Office, you agree to these Terms. If you do not agree, do not use our services.

2. Our Services

Ethereal Office answers phone calls, sends and receives text messages, and books appointments on behalf of subscribing businesses (for example, your local plumbing or HVAC company). When you call or text a business that uses Ethereal Office, you are communicating with that business through technology we operate for them.

Our software products (Ethereal Planes, Ethereal Host, ResuBuild) are licensed to you for personal or internal business use and may offer free and paid tiers as described on their respective product pages.

3. SMS / Text Messaging Terms

These terms apply to text messages sent from phone lines operated by Ethereal Office on behalf of subscribing businesses (the "Program").

Program Description

The Program sends transactional and conversational messages related to your service request, such as missed-call follow-ups, appointment confirmations, appointment reminders, scheduling changes, and replies to your inquiries.

Opt-In / Consent

You opt in to the Program by calling a business that uses Ethereal Office and providing your phone number to request service or a callback, by texting such a business first, or by submitting your phone number to the business through a form or in person. Consent to receive text messages is not a condition of purchasing any goods or services.

Message Frequency

Message frequency varies based on your interaction with the business (typically a few messages per service request).

Fees

Message and data rates may apply according to your mobile carrier plan. Ethereal does not charge you for receiving messages.

Opt-Out: Reply STOP to any message to cancel and stop receiving texts from that number. You will receive a single confirmation message, after which no further messages will be sent.

Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Supported carriers include all major U.S. carriers; delivery is subject to carrier network availability.

Privacy

Phone numbers and message content are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except as required to deliver messages or by law.

4. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose or in violation of any applicable regulation
  • Attempt to gain unauthorized access to our systems or another user's data
  • Interfere with, disrupt, or reverse engineer our services except as permitted by law
  • Use our services to send spam, harassing, or fraudulent communications
  • Resell or sublicense our services without a written agreement with us

5. Subscriptions & Billing

Paid services are billed in advance on a monthly subscription basis through our payment processor (Stripe). Unless otherwise stated in a written agreement:

  • Subscriptions renew automatically each month until canceled
  • You may cancel at any time; service continues through the end of the paid period
  • Fees are non-refundable except where required by law
  • We may change pricing with at least 30 days' notice before your next renewal

6. Intellectual Property

Our services, software, branding, and content are owned by Ethereal, Inc. and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use our services as intended. You retain all rights to the data and content you provide to us.

7. Disclaimers

Our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that every call or message will be delivered, answered, or accurately transcribed.

Ethereal Office is a communications tool. The subscribing business — not Ethereal — remains responsible for the services it provides to its customers, including pricing, scheduling commitments, and workmanship.

8. Limitation of Liability

To the fullest extent permitted by law, Ethereal, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of our services. Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the twelve months preceding the claim.

9. Termination

You may stop using our services at any time. We may suspend or terminate access to our services for violation of these Terms, non-payment, or where required by law. Sections that by their nature should survive termination (including Sections 6–8) will survive.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
